In order to have a speedy resolution of project related cases, the UP RERA has decided to opt the example of Maha RERA, where they have been trying to solve 25 cases a day and wrapping up hearing in 30 days. Recently, the Uttar Pradesh Real Estate Regulatory Authority (RERA) has announced to open its western UP bench in Greater Noida which will start its first hearings from next week.
The decision took place in a recently concluded meeting in which members of UP RERA stated that Maha RERA had been resolving most cases through out-of-court amicable settlements and that’s why they would look to do the same. The Greater Noida bench will become functional on September 4, has already got 4,000 complaints filed primarily by homebuyers in Noida, Greater Noida, and Ghaziabad.
According to a senior member, UP-RERA, “Hearing would happen project-wise and complaints would be heard at a stretch till all pending issues of that particular project were dealt with. Once a file is opened by the authority, in the presence of builder, buyers, and others involved, it may either begin a series of hearings leading to an order or work out a settlement acceptable to all.”
“Our first criterion is to get the buyers possession of their apartments. The buyer has paid for the flat and should have the keys to the flat. Even if there are some issues that need resolution, negotiations can continue but our priority will be to get builders to hand over flats.” Member added.
He also said that that Maharashtra model of disposing of cases has been very successful and by adopting it, we will take matters in the direction of conflict resolution instead of leading them on to become long litigations.
It is decided that the western bench will function from the old building of the Greater Noida Authority’s office in Gamma 2. While two members will sit here and look after the complaints, the rest two will hear cases from Lucknow office.
