The Ghaziabad Development Authority [GDA] gave notice to 46 developers in the city as all of them failed to execute flat registration till now. GDA directed these developers to finalize the registration process by October 15 and also said that the developers stay read to face legal action in case of not completing the registration procedure. Interestingly, all these developers have received full payment for the flats and also handed over the possession of these residential units to the homebuyers.
The legal action against the developers for not executing flat registration will be taken under the UP Apartment Act and the Registration Act. The action will be taken in case the developers fail to complete the registration process well in time as the developer requires to get the sale deed executed before giving away the possession of a unit.
This decision came as a relief to the homebuyers. According to Section 13 of the UP Apartment Act, “No promoter or an apartment owner shall transfer or hand over the possession of any apartment constructed after the commencement of this Act without executing an appropriate transfer deed and also getting it registered under the provisions of the Registration Act, 1908 and it shall also be incumbent for such promoter or apartment owner to enclose a true copy of the declaration made under Section 12 to such deed of transfer.”
Unregistered flat clearly means that the homeowners don’t have a legal right to own that particular property. The officials at the stamps department, says that nearly 10,000 homes constructed by various developers are still unregistered and many of them are located in Vasundhara, Indirapuram, Vaishali and Raj Nagar Extension.
